Over the past decades, India has seen arbitration grow in prominence as a preferred dispute resolution mechanism. Where the Government of India is party to a dispute, however, the advantages of arbitration have not always materialised.
Alternative dispute resolution (ADR) has become an important way to resolve various types of disputes outside of the court system in Cambodia.
As part of its efforts to manage the increasing caseloads of the Myanmar Courts, the Supreme Court of the Republic of the Union of Myanmar (USC) introduced a court-led mediation programme in March 2019.
The National Commercial Arbitration Centre (“NCAC”) is a non-profit commercial dispute resolution institution based in Phnom Penh, Cambodia. On 18 March 2023, the General Assembly of the NCAC adopted three main documents to allow the NCAC to provide mediation services.
This article provides a summary of the current state of mediation in Cambodia. It also gives an insight into the current legal and regulatory developments relating to mediation and what can be expected of mediation in Cambodia in the near future.

To offer another chance at preserving relationships, Arb-Med-Arb has emerged as a means of incorporating mediation into the arbitral process, where parties who have commenced arbitration may “pause” proceedings to attempt to settle the dispute by mediation.

Conditional fee agreements (“CFAs”), which were previously prohibited under Singapore law, are now allowed for specific contentious proceedings. On 4 May 2022, the framework for CFAs in Singapore came into operation.
